1. Agreement to Terms

By accessing or using oyaah ("Service", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Service Description

oyaah provides AI-powered data analysis services that allow users to upload CSV and Excel files for automated analysis, insights, and visualizations.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts

When you create an account with us, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access
  • Not share your account credentials with others

You must be at least 16 years old to use this Service. By using the Service, you represent that you meet this age requirement.

4. Acceptable Use Policy

You agree NOT to use the Service to:

  • Upload files containing illegal, harmful, or malicious content
  • Upload files containing personal data of others without authorization
  • Violate any laws, regulations, or third-party rights

  • Interfere with or disrupt the Service or servers

  • Reverse engineer, decompile, or disassemble any part of the Service
  • Upload viruses, malware, or any malicious code
  • Impersonate others or misrepresent your affiliation
  • Use the Service for any unauthorized commercial purpose

Violation of this policy may result in immediate termination of your account and legal action if necessary.

5. Intellectual Property

The Service, including its original content, features, and functionality, is owned by oyaah and is protected by international copyright, trademark, and other intellectual property laws.

Your Content:

You retain all rights to the data files you upload. By uploading files, you grant us a limited license to:

  • Process and analyze your files
  • Store files temporarily for the analysis period
  • Generate insights and visualizations

This license terminates when you delete your files or after the retention period specified in our Privacy Policy.

6. Subscriptions and Payments

Free Trial:

We offer a 14-day free trial for paid plans. No credit card is required to start. You can cancel anytime before the trial ends without charge.

Paid Subscriptions:

  • Subscriptions are billed monthly or annually in advance
  • All fees are in USD unless otherwise stated
  • Subscriptions auto-renew unless cancelled before the renewal date
  • We may change pricing with 30 days notice to existing subscribers
  • No refunds for partial months, except as required by law

Refund Policy:

We offer a 14-day money-back guarantee for first-time paid subscriptions. Contact us within 14 days of your first payment for a full refund.

Cancellation:

You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You'll retain access until then.

7. Data Processing and AI

AI-Generated Content: Our Service uses AI (Google Gemini) to analyze your data. While we strive for accuracy, AI-generated insights may contain errors or inaccuracies. You should verify critical insights independently.

No Guarantees: We do not guarantee specific outcomes, accuracy, or completeness of analysis results. The Service is provided "as is."

Your Responsibility: You are responsible for ensuring your uploaded data complies with applicable laws and does not violate third-party rights.

8. Limitations of Liability

To the maximum extent permitted by law, oyaah shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from your use or inability to use the Service
  • Errors or inaccuracies in AI-generated insights
  • Unauthorized access to your data due to security breaches
  • Service interruptions or downtime

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months before the claim arose, or $100, whichever is greater.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Non-infringement of third-party rights
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation
  • Security of data transmission or storage

10. Indemnification

You agree to indemnify, defend, and hold harmless oyaah and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your uploaded content

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including:

  • Breach of these Terms
  • Suspected fraudulent or illegal activity
  • Non-payment of fees
  • At our sole discretion

Upon termination, your right to use the Service ceases immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

For EU/EEA Users: You have the right to bring disputes before the courts in your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

Dispute Resolution: We encourage you to contact us first to resolve any disputes informally. For formal disputes, we agree to attempt good-faith mediation before pursuing litigation.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We'll notify you of material changes by email or through a prominent notice on the Service at least 30 days before the changes take effect.

Continued use of the Service after changes constitutes acceptance of the new Terms. If you disagree with the changes, you must stop using the Service and cancel your account.
